TERMS AND CONDITIONS OF USE CARIBBEAN VENTURE LQV.
To use the Reservation Area, you must be at least 18 years old, be legally able to contract and use this site in accordance with these General Conditions. Therefore, when making your reservation, you declare and acknowledge compliance with this condition and the other terms described below.
You are financially responsible for the use of the site both on your behalf and on behalf of third parties, including minors, unless you can prove fraudulent use that is not the result of your fault or negligence. You also guarantee the truthfulness and accuracy of the information provided by you or any other third party that uses your data on this Site.
STEPS FOR RESERVATION AND CANCELLATION.
The reservation procedure includes at least the following steps:
- Follow the instructions and select the tour of your choice in the domain.
- Indicate which date and which time, within those available, is of your convenience.
- Select the number of people, adults and children.
- You may then, subject to having previously accepted these conditions and followed these steps, validate your request. A message informs you that your request has been processed.
- Next, the request is validly registered.
- After payment, your reservation is definitively validated, the confirmation email accompanied by a QR code, is equivalent to an electronic ticket.
PAYMENT BY CREDIT CARD AND ELECTRONIC COMMERCE.
The staff of the Caribbean Venture LQV company is authorized to receive information about your bank card via the web domain to pay for the services requested from the Caribbean Venture LQV company through the Paypal, Visa, American Express and Mastercard platforms.
EXCURSION CONDITIONS.
Caribbean Venture LQV reserves the right to modify the circuits or cancel the services in case of bad weather conditions. Only the captain is authorized to judge sailing conditions and may cancel a maritime service. In case of cancellation by Caribbean Venture LQV, passengers may be reimbursed or the excursion may be postponed to another date with their consent.
Swimming is authorized during stopovers at your own risk. Passengers agree in any case to comply with the regulations on board the ships, established by Caribbean Venture LQV as well as to submit to the orders of the captain and his companions. Passengers must arrive 30 minutes before departure time at our offices in El Cortecito, whose address can be found in the "Address" section of this website.
If you opt for the pick-up service or “Pick Up”, in accordance with these terms and conditions, you acknowledge that both you and any accompanying passenger must be ready at least 15 minutes before and in the lobby of the selected pick-up point.
In the event of passenger delay in both scenarios, the passenger acknowledges Caribbean Venture LQV's right not to offer a refund.
THE SERVICE.
WHAT INCLUDES?
In addition to the contracted Tour, we offer alcoholic and non-alcoholic beverages, as well as snacks or refreshments during the tour, on board the boat, fully included in the package.
WHAT IS NOT INCLUDED?
Consumption within the establishment or offices of Caribbean Venture LQV, which must be covered individually by the passenger or passengers who choose to use the products and/or services offered by Caribbean Venture LQV.TRANSPORTATION TITLE AND ACCEPTANCE OF THE CONTRACTUAL CONDITIONS.
The subscription to an online reservation on the Caribbean Venture LQV website is a contract that implies the acceptance of these general conditions of sale and transport by all participants in the nautical and aquatic activities offered by Caribbean Venture LQV on whose behalf made the reservation.
The electronic ticket, which corresponds to the online (or email) confirmation of your reservation by Caribbean Venture LQV is personal and non-transferable. It must be kept by the customer who made the online reservation for one or more people. In case of negligence or imprudence in its possession or preservation, Caribbean Venture LQV is not responsible.
It is governed by the contractual provisions set forth in these terms and conditions, as well as by the legal and regulatory provisions of mandatory compliance contemplated in the Civil Code of the Dominican Republic.
HEALTH STATUS OF PASSENGERS.
Passengers must inform Caribbean Venture LQV of any contraindication or disability that contravenes the provision of the services it offers (Nautical activities: maritime excursion, nautical and aquatic sports, swimming, diving with a mask and snorkel, etc.)
Passengers embark at their own risk and cannot hold Caribbean Venture LQV responsible in case of bodily injury related to their state of health (disability, illness, etc.), whether on board or during embarkation or disembarkation operations, or during nautical operations or water activities.
Passengers who need, due to their state of health, special assistance during the excursion or nautical and aquatic activities (person with reduced mobility, visually impaired, etc.) are obliged to inform the Caribbean Venture LQV navigation crew when making the reservation and boarding.
PREGNANT WOMEN.
Pregnant women can take a maritime excursion, under their sole responsibility, beyond 2 months and up to 6 months of gestation not completed, upon presentation to Caribbean Venture LQV of a medical certificate of no contraindication for maritime navigation. However, Caribbean Venture LQV will not assume responsibility for any bodily injury.
Caribbean Venture LQV is not responsible for any bodily injury or any other incident related to pregnancy.
Nautical and aquatic activities (water skiing, towed buoys, jet skis, etc.) are prohibited for pregnant women.
MINORS.
Caribbean Venture LQV does not provide transportation for unaccompanied minors. They will embark and participate in excursions, as well as in nautical and aquatic activities under the exclusive responsibility of their companion or guardian.
For children under two years of age, it is mandatory to wear a suitable life jacket. Parents must notify Caribbean Venture LQV of their presence when booking or prior to boarding.
PASSENGER BEHAVIOR.
Passengers must remain seated during navigation. They must comply during embarkation and disembarkation operations, as well as on board, with the regulations of the catamaran, in particular those established by Caribbean Venture LQV and, in general, comply with the recommendations or instructions of the captain, his assistants and all the staff or crew.
Caribbean Venture LQV is exempt from all liability for any bodily injury or damage to the physical or moral integrity of passengers who do not comply with this statement either on board or during embarkation or disembarkation operations.
Passengers will be responsible for any damage of any kind that they may cause to themselves, to other passengers, to third parties or to persons and property of Caribbean Venture LQV.
The same applies to all damage of any kind caused by persons or property in the care of passengers.
Caribbean Venture LQV authorizes swimming during excursions during "swim breaks". However, this is not supervised and is done under the responsibility of the passengers. On this occasion, minors will be under the responsibility of their companion(s). People who cannot swim or cannot swim well should inform the navigation crew.
Caribbean Venture LQV provides passengers with buoys and/or life jackets.
Caribbean Venture LQV disclaims all responsibility in case of incidents or bodily injuries that occur during the bath.
DAMAGE.
Any damage that occurs during excursions or nautical and aquatic activities must be reported by the passenger to Caribbean Venture LQV before leaving the ship.
In case of damage to their person and/or their property (personal belongings, etc.), passengers must inform the ship's staff.
Caribbean Venture LQV disclaims all responsibility (except in cases where these arise from causes attributable to it) for bodily accidents that occur during navigation, during excursions or nautical and aquatic activities, or during embarkation or disembarkation operations, either whether at ports of departure or destination, or at ports of call, or at sea while swimming.
PERSONAL OBJECTS OR MATERIALS.
Passengers may board their personal equipment(s) (camera, mask, snorkel, fins) at their own risk.
Caribbean Venture LQV declines all responsibility for luggage, object(s) or personal equipment(s) carried on board by passengers, as well as for money, jewelry or other valuables that remain during excursions and any other activities. offered by Caribbean Venture LQV under the sole responsibility of its owners.
FREE LOAN OF EQUIPMENT.
Caribbean Venture LQV provides passengers with free lifesaving equipment as part of the nautical and water activities it offers.
Where applicable, defective equipment does not entitle you to any refund or reduction.
Caribbean Venture LQV reserves the right to charge or initiate legal action against passengers who have damaged or degraded equipment loaned free of charge.
ORGANIZATION OF FESTIVE EXCURSIONS.
As part of the festive evenings and excursions organized by Caribbean Venture LQV (cocktails, parties, bachelorette parties, bachelor parties, etc.) moderate consumption of alcohol and tobacco is allowed.
For reasons of passenger safety and comfort, Caribbean Venture LQV staff may need to limit or prohibit the use of alcohol or tobacco, or even drugs.
Caribbean Venture LQV may implement all necessary steps, or restrictions, with respect to passengers who, due to their behavior: Endanger a person or member of staff, degrade or damage property belonging to Caribbean Venture LQV, prevent staff from carrying out your duties, do not follow the recommendations and instructions of staff members or the captain.
Caribbean Venture LQV reserves the right to disembark passengers whose behavior endangers the safety, tranquility or comfort of other passengers or staff members.
FINANCIAL CONDITIONS.
The descriptions of the Services presented on the Site specify, for each service, the services included in the price. Prices are in US dollars. In general, it is understood that the prices of the services include all taxes, charges and reservation costs included.
Payments made on the Site are made by credit card (network cards, Visa, MasterCard, American Express are accepted) through a secure payment system.
In the event that the payment is irregular, incomplete or non-existent, for any reason attributable to the user, the sale of these services will be cancelled, and the resulting costs will be at your expense, civil and / or criminal action that, where appropriate, may go against himself.
CONDITIONS OF CANCELLATION OF YOUR EXCURSION.
Due to Caribbean Venture LQV:
If for reasons of bad weather conditions or technical problems in the boats the departure could not be carried out, the amounts advanced would be fully reimbursed, no fees would be withheld.
Due to customer:
If for personal reasons you decide to cancel your tour forty-eight (48) hours or more prior to the tour date, your deposit will be returned in full and no charges will be withheld. (pending validation
of the amount of commissions, if any)
In the event that the cancellation of your excursion occurs less than forty-eight (48) hours prior to the date of the excursion, your deposit will not be refunded.
The cancellation must be sought by the interested party within the terms and conditions indicated above through the channels that Caribbean Venture LQV makes available to them and are indicated below:
- Through an authorized seller of Caribbean Venture LQV.
- Through a contact form or Chatbot that you will find in this domain.
PHOTOS AND ILLUSTRATIONS.
Caribbean Venture LQV makes every effort to provide photographs and illustrations that give you an overview of the selected services.
PROPOSED ACTIVITIES.
It may happen that certain activities offered by Caribbean Venture LQV and indicated in the description that appears on the Site are cancelled, in particular for climatic reasons or in case of force majeure.
INTELLECTUAL PROPERTY.
Caribbean Venture LQV, is the owner of all intellectual property rights related to the Site that belongs to them or has the rights of use related to it.

In transportation related to excursions, the carrier is not responsible in case of change of route, schedule or cancellation of departures due to force majeure, fortuitous or otherwise. Once the ship has sailed, no claims will be accepted regarding the applicable rate or the itinerary carried out.
PERSONAL DATA PROTECTION.
In accordance with article 44 of the Dominican Constitution and Law 172-13 on the integral protection of personal data, Caribbean Venture LQV informs its users that the data entered in this web domain remain entirely at the discretion and use of Caribbean Venture LQV without being transferred to a third party.
APPLICABLE LAW.
THE GENERAL CONDITIONS, AND MORE GENERALLY THE CONTRACT CONCLUDED WITH Caribbean Venture LQV, ARE SUBJECT TO THE LEGISLATION OF THE DOMINICAN REPUBLIC. ANY DISPUTE RELATED TO ITS INTERPRETATION AND/OR ITS EXECUTION IS SUBJECT TO THE COURTS OF THE REPUBLIC.
